AN ACT

To amend the Superannuation Act 1966-1968.

Enacted by the Parliament of Nauru as follows:

SHORT TITLE AND CITATION

1 (1) This Act may be cited as the Superannuation (Amendment) Act, 1973.

(2) The Superannuation Act 1966-1968 is in this Act referred to as the principal Act.

(3) The principal Act as amended by this Act may be cited as the Superannuation Act 1966-1973.

AMENDMENT TO SECTION 21 OF THE PRINCIPAL ACT

2. Section 21 of the principal Act is amended:

(a) in subsection (4), by inserting after the words "the contributor is required" the words and punctuation ", subject to the next following subsection," and
(b) in subsection (5), by deleting paragraph (a) and by substituting therefor the following new paragraph (a) -

• "(a) a contributor by reason of an increase in his salary is required by virtue of subsection (2) to contribute for an additional unit or additional units of pension".

EFFECTIVE DATE OF AMENDMENT OF SECTION 21 OF THE PRINCIPAL ACT

3. The amendment of section 21 of the principal Act made by section 2 of this Act shall be deemed to have been made on 1st September, 1971, and shall have effect accordingly.

AMENDMENT OF SECTION 33 OF THE PRINCIPAL ACT

4. Section 33 of the principal Act is amended by numbering it as subsection (1) and by adding the following new subsection (2) -

"(2) For the purposes of this Act, a police officer who retires on completion of the period of service referred to in subsection (2) of section 8 of the Nauru Police Force Act 1972 shall be deemed, whether or not he has served for ten years or more continuously, to be retrenched on the date on which he retires."

EFFECTIVE DATE OF AMENDMENT OF SECTION 33 OF THE PRINCIPAL ACT

5. The amendment of section 33 of the principal Act made by section 4 of this Act shall be deemed to have been made on 1st March, 1972, and shall have effect accordingly.

NOTIONAL DATE OF RETIREMENT IN CERTAIN CASES

6. For the purposes of subsection (2) of section 39 of the principal Act, a police officer who has retired before the certification of this Act on completion of the period of service referred to in subsection (2) of section 8 of the Nauru Police Force Act 1972 shall be deemed to have been retrenched on the date of that certification.
