AN ACT

To amend the Public Service Act 1961-1975.

Enacted by the Parliament of Nauru as follows:

SHORT TITLE

1. This Act may be cited as the Public Service (Amendment) Act 1979.

THE PRINCIPAL ACT

2. (1) In this Act "the Principal Act" means the Public Service Act 1961-1975.

(2) The principal Act as amended by this Act may be cited as the Public Service Act 1961-1979.

REPEAL AND REPLACEMENT OF SECTION 45(1) OF THE PRINCIPAL ACT

3. Section 45(1) of the principal Act is hereby repealed and replaced by the following new subsection 45(1) -

"45(1) Subject to this Act, the Commissioner may grant to every officer and employee leave of absence for recreation for a period of periods not exceeding in the whole twenty days (exclusive of Sundays, Saturdays and Holidays) in respect of each year of his service."

APPLICATION

4. (1) The provisions of section 45(1) of the principal Act as amended by this Act shall apply in respect of service of every officer or employee after the Thirtieth day of June 1979, but in respect of the principal Act in the form appearing before the enactment of this Act shall apply.

(2) Subsection (1) shall apply pro rata to any part of a year of service of every officer or employee falling before First July 1979 or after Thirtieth June 1979, as the case may be:

Provided that the continuous period of service of the officer or employee concerned, before and after the said dates respectively, is at least twelve months.
