AN ACT


To provide for the withdrawal and expenditure of monies from the Treasury Fund to meet the expenditure of the Republic for the Financial Year ending on the thirtieth day of June, Two thousand and seven.

BE IT ENACTED by the Parliament of Nauru as follows-


SHORT TITLE


1. This Act may be cited as the Appropriation Act 2006-2007.


INTERPRETATION


2. In this Act-


'the Treasury Fund' means the fund established under Article 58 of the Constitution of Nauru;


'the Financial Year' means the year commencing on the first day of July, One thousand and six and ending on the thirtieth day of June, One thousand and seven;


'head' means a department or division of the expenditure of the Republic listed in the schedule to this Act;


'subhead' means a subdivision of a head.


COMMENCEMENT AND EXPIRY


3. This Act shall come into force on the first day of July, Two thousand and six and shall cease to have effect on the thirtieth day of June, Two thousand and seven.


WITHDRAWAL OF MONEY FROM THE TEASURY FUND


4. (1) A sum not exceeding $22,225,935 may be withdrawn from the Treasury Fund and expended as authorised in the Schedule to this Act.


(2) The amounts in the Schedule this Act are in substitution for and not in addition to any other Act providing Supply or an Appropriation to the Government in 2006-07 that may be approved by Parliament before this Act comes into force.


(3) Where the Cabinet considers it necessary to increase the amount assigned in the estimates to a particular subhead within a Head, the Cabinet may direct that there shall be applied to the aid of that subhead a further sum out of any surplus arising on any other subhead within the same Head, but so that the total amount withdrawn and expended does not exceed the amount authorised for that Head in the Schedule to this Act.


(4) Where the Cabinet authorises a transfer of fund between subheads within a Head in accordance with sub-section (3), it shall cause to be laid before the Parliament at its first meeting of the Parliament after it has approved the transfer, a copy of the order of the Cabinet approving such transfer.
