Traditional Rights Court of the Marshall Islands |
IN THE TRADITIONAL RIGHTS COURT
OF THE
REPUBLIC OF THE MARSHALL ISLANDS
CIVIL ACTION NO. 2000-025
LUCKY JUDA
Plaintiff
vs
HOSEIA JOSEHIA
Defendant
RULE 9 ORDER BY THE HIGH COURT TO THE TRADITION RIGHTS COURT FOR A SUPPLEMENTAL OPINION IN ANSWER
TO: | Hon. Chief Justice Carl B. Ingram, High Court |
| Dennis Reeder, counsel for Plaintiff Lucky Juda |
| Chief Public Defender, Russell Kun, counsel for Defendant Hoseia Joseiha |
To accommodate the Rule 9 order, the Traditional Rights Court officially reconfirm its previous opinion that Plaintiff Lucky Juda, based on all testimonies and evidence presented, is the proper person to hold the senior dri jerbal title/rights on Monunnar Wato on Bikini Atoll.
The Traditional Rights Court did not rule on who is the rightful dri jerbal or senior dri jerbal on the "southern tip of Kili Island". Politically, Kili Island is not associated with Bikini Atoll in receiving money from the U.S Government. Kili Island, as of today is still a public land. Therefore, the people live and enjoy the land, but they are not the owner.
Then, how can the parties in this caption matter claim that the "southern tip of Kili Island is theirs? Not one of them is the rightful owner.
