ORDER

HAVING HEARD Mr Rubetaake, Counsel for the Appellant, and Mr Beniata, Counsel for the Respondent; IT IS HEREBY ORDERED that the decision of the Abaiang Magistrates' Court given on 24^th July 2017 is quashed.

The matter is remitted to the Abaiang Magistrates' Court for a retrial based on the directions for ascertaining the titles of the concerned land owners and the evidence adduced by both parties.
