[1] Two applications were set down to be heard today. Mr Berina applied for judgment on the basis of the concession made by the respondent in its statement of defence. Ms Noa applied to amend the statement of defence to remove the concession.
[2] In light of Ms Noa's application, Mr Berina withdrew his application provided Ms Noa files and serves an amended statement of defence within 14 days of today's date and pays costs of $300. Ms Noa agreed to these conditions.
[3] The application for judgment is withdrawn. The application to amend the statement of defence is granted. The amended statement of defence must be filed and served within 14 days of today's date.
[4] Costs of $300 are awarded to the applicant.
