SENTENCE


Muria, CJ: Having heard Counsel for the prosecution and defence, and considering the circumstances of the case, the Court takes into account all that had been done to the accused in the form of punishment and the circumstances of the accused himself, and all that has been submitted on his behalf, I feel the accused should be treated in the light of the circumstances of this case.


The sentence of the Court is therefore:
Count 1 – two years’ imprisonment.
Count 2 – one year’s imprisonment.


The sentences are consecutive – three years total. The sentence however is suspended on the condition that the accused be of good behaviour for a period of 12 months. Failure to comply with the good behaviour condition, the accused is to be brought back to Court to be ordered to serve his sentence.
