Republic v Tebwebwe [2015] KIHC 64; Criminal Case 46 of 2011 (6 August 2015)

IN THE HIGH COURT OF KIRIBATI

CRIMINAL CASE NO. 46 OF 2011

BETWEEN

THE REPUBLIC
PROSECUTOR

AND

KAIKAI TEBWEBWE
ACCUSED

Before: The Hon Justice Vincent Zehurikize

6 August 2015

Mr Taburuea Rubetaake for Prosecutor
Mr Banuera Berina for Accused

SENTENCE AND REASONS FOR IT

Zehurikize, J: I have considered the agreed position by both Counsel. I further note that the convict is a first offender since no previous record has been presented. He has pleaded guilty thereby saving the Court's time and scarce resources.

Considering all the circumstances of this case and doing the best I can I sentence the convict to a term of six years' imprisonment. But the service of the sentence shall be suspended for the same period on account of good behaviour. If during this period the convict commits any other offence he will be arrested and committed to prison to service the above sentence in addition to any other sentence that may be imposed in such future proceedings.

Dated the 6th day of August 2015

THE HON MR JUSTICE VINCENT ZEHURIKIZE
Judge
