ORDER

Having heard Ms Tekanito of Counsel for the plaintiff and Mr Tekanene of Counsel for the defendant IT IS ORDERED BY CONSENT that Civil Case 136/12 be struck out as being irregularly brought. Liberty to the plaintiff to re-issue proceedings within 14 days. The plaintiff shall pay $80.00 costs to the defendant.

The Court fee paid at the filing of Civil Case 136/12 be accepted as filing fee for the re-issue of the proceedings as ordered only if the plaintiff re-issues proceedings within the said 14 days and the costs of $80.00 is paid.
