Republic v Arebonto [2010] KIHC 59; Criminal Case 10 of 2010 (8 June 2010)

IN THE HIGH COURT OF KIRIBATI
CRIMINAL JURISDICTION
HELD AT BETIO
REPUBLIC OF KIRIBATI

High Court Criminal Case 10 of 2010

THE REPUBLIC

V

KOURABI AREBONTO

For the Republic: Ms Tewiia Tawita
For the Accused: Ms Abunaba Takabwebwe

Dates of Hearing: 7 & 8 June 2010

SENTENCE

Kourabi Arebonto: you have been found guilty of acts causing grievous bodily harm. The facts are in my judgment. In brief you cut off the victim’s left hand during a fight with him. I accept Dr Bauro’s opinion that you did it with one blow using something very sharp. It must have been deliberate. You have maimed Nakataba for life. It was a terrible thing to do.

You are 27 years old married with one child. You have lived a subsistence life style. You have no previous convictions. I take into account all Ms Takabwebwe’s submissions especially that you yourself were injured. Your injuries were not as serious as Nakataba’s and you still have all your limbs. You appear to have recovered. He never can.

The crime requires a severe penalty. You will be imprisoned for eight years to run from last Monday 7th June.

Dated the 11th day of June 2010

THE HON ROBIN MILLHOUSE QC
Chief Justice
