Republic v Boiti [2010] KIHC 43; Criminal Case 04 of 2010 (16 April 2010)

IN THE HIGH COURT OF KIRIBATI
CRIMINAL JURISDICTION

High Court Criminal Case 4 of 2010

HELD AT BETIO
REPUBLIC OF KIRIBATI

THE REPUBLIC

V

KORERE BOITI

For the Republic: Ms Pauline Beiatau
For the Accused: Mr Raweita Beniata

Date of Hearing: 15 April 2010

SENTENCE

Korere Boiti: you have been found guilty of indecent assault and criminal trespass. You took a little girl of six from the place where she was sleeping with members of her family and were found on the beach lying on top of her. You say you were so drunk at the time you do not remember anything about it.

You were 16 and these are your first convictions. Yet what you did was most seriously wrong. You violated the privacy of the home of friends and at night took away a young child. It was lucky for the girl and for you that you were disturbed when you were.

I take into account Mr Beniata’s submissions but you must serve a term of imprisonment and the term will not be suspended.

For criminal trespass you will be imprisoned for six months. For indecent assault you will be imprisoned for two years.

As the offences arose out of the same incident the sentences will be served concurrently. They will run from last Monday 12 April when you went into custody.

Dated the 16th day of April 2010

THE HON ROBIN MILLHOUSE QC
Chief Justice
