In the High Court of Kiribati

Held at Betio
Republic of Kiribati

High Court Criminal Case 58 of 2010

The Republic

v

Tebau Nantoki

For the Republic: Ms Tewia Tawita
For the Accused: Mr Raweita Beniata

Date of Hearing: 1 November 2010

SENTENCE

Tebau Nantoki: you have been found guilty of indecent assault. The victim was your niece, a girl of 13. You are 40.

Mr Beniata in making submissions for you has stressed your worry over your five year old daughter. Her mother is dead and she has gone with your present partner, whom she loves, to Beru. You are anxious to be with them. Your late wife's family has been very angry with what you did. Your apology has been refused.

You have no previous convictions. That is the only thing in your favour which would mean a shorter sentence of imprisonment. I take it into account.

Mr Beniata has submitted that any sentence of imprisonment should be suspended. Despite his submissions your sentence will not be suspended.

You are sentenced to three months' imprisonment to run from 4 November when you went into custody.

Dated the 8th day of November 2010

THE HON ROBIN MILLHOUSE QC
Chief Justice
