ORDER


Declare that:


  1. The Union is competent to represent the interests of its members and to file and conduct appeals on their behalf.
  2. The delay or refusal by the Defedant to consider the appeals of the Plaintiff's members is unreasonable and unjustified.
  3. The officers of the Union, Nei Kamaua and Tekarika did not commit any offence against Conditions of Service C27 and the Defendant was in error in imposing penalty on them.
  4. The officers of the Union, Nei Kamaua and Tekarika are entitled to damages equivalent to the salary payable to them for 20 working days.

The Plaintiff to have costs.
