SENTENCE
Teruru Obeta: after a trial in which you were charged with murder you were found guilty of assault. The facts are in the reasons which I gave on 1 September. In the circumstances of the case I regard it as a serious assault even though I could not find that you caused actual bodily harm.
You are 23 years old. You have been providing for your mother and stepfather by doing casual work.
You have no previous convictions. That is in your favour and means a less severe penalty than otherwise.
Ms Kirata says that you are truly sorry for your part in this terrible affair. You promise not to drink alcohol again or hang round with bad associates. You will start a new life by returning to church. I hope indeed that you will keep these promises.
Ms Kirata has asked that any sentence of imprisonment be suspended. The assault was serious and there are no special circumstances justifying suspension.
You are sentenced to four months' imprisonment to run from 6 August when you first went into custody.
