Taokai v Tuabon [2009] KIHC 63; Civil Case 58 of 2009 (2 November 2009)

IN THE HIGH COURT OF KIRIBATI
CIVIL JURISDICTION
HELD AT BETIO
REPUBLIC OF KIRIBATI

HIGH COURT CIVIL CASE 58 OF 2009

BETWEEN:

BATIRIO TAOKAI
APPLICANT

AND:

KAUMAI TUABON MTMM
RESPONDENT

For the Applicant: Mr Raweita Beniata
For the Respondents: Mr Banuera Beria

Date of Hearing: 2 November 2009

JUDGMENT
(Ex Tempore)

These reasons should be read in conjunction with my memorandum of 30 September.

The documents have now come from TabSouth. They shew that the respondent’s father was registered over the land with his brothers and sisters on 19 May 1970. The father has now passed away. In CN 19/05 the respondent registered his name after his father with his brothers and sisters. His father having died, the respondent was entitled to do this: the decision in CN 19/05 should stand.

The applications both to extend time and for an order for certiorari are refused.

THE HON ROBIN MILLHOUSE QC
Chief Justice
