Kabunare v Republic [2008] KIHC 69; Criminal Appeal 23 of 2008 (26 November 2008)

IN THE HIGH COURT OF KIRIBATI
CRIMINAL JURISDICTION
HELD AT BETIO
REPUBLIC OF KIRIBATI

High Court Criminal Appeal 23 of 2008

BETWEEN:

Katoo Kabunare
Appellant

AND:

The Republic
Respondent

For the Appellant: Mr Raweita Beniata
For the Respondent: Ms Pauline Beiatau

Date of Hearing: 26 November 2008

JUDGMENT
(Ex Tempore)

The facts in this appeal are similar to those in CN 22/08: the appellant was caught speeding, not for the first time. The Single Magistrate suspended his driving licence for six months. For the reasons I gave in CN 22/08 the Single Magistrate had the power to do that. The appeal is dismissed.

THE HON ROBIN MILLHOUSE QC
Chief Justice
