JUDGMENT


The Court in its civil jurisdiction has granted the application for an order of certiorari to allow the review of the decision of the South Tarawa Magistrates Court in CN 126/1999.


When the case came on for hearing by the Court in its Lands jurisdiction Mr Berina conceded that the decision in CN 126/1999 should be quashed: his client had gone to the Court alone without his siblings who had an interest in the land knowing of it.


The decision of the Single Magistrate in CN 126/1999 is quashed.
