Republic v Angka - sentence [2006] KIHC 45; Criminal Case 30 of 2005 (2 March 2006)

IN THE HIGH COURT OF KIRIBATI
CRIMINAL JURISDICTION
HELD AT BETIO
REPUBLIC OF KIRIBATI

High Court Criminal Case No. 30 of 2005

THE REPUBLIC

vs

IOANE ANGKA

For the Republic: Ms Olga Guillen
For the Accused: Mr Karotu Tiba

Dates of Hearing: 27 February 2006

SENTENCE

Ioane Angka: you have been convicted of indecent assault. In the night you took a little girl from her house. The parents who had not been at the house when you took their daughter realized she was missing. Searchers found you with the child some 100 metres away with your head between the child’s legs.

You say you were drunk at the time. What you did was utterly wrong. It was lucky you were caught when you were or the consequences might have been worse. As it is what you did was a very serious indecent assault.

You have no previous convictions. That is in your favour and means a less term of imprisonment than otherwise.

At the time you were 64 years old: the little girl was 7.

You are not married. Your home island is Marakei.

You will be imprisoned for three years, the term to run from yesterday, 1 March when you went into custody.

Dated the 2nd day of March 2006

THE HON ROBIN MILLHOUSE QC
Chief Justice
