JUDGMENT


By consent, order dated 26 July 2006 is revoked and the following order made:


  1. THAT the Annual General Meeting (‘Meeting’) of the Kiribati School for the Disabled Parents’ Support Group be held at the school compound in Bikenibeu from 10 am on Saturday 26 August 2006 and in accordance with the Group’s Constitution.
  2. THAT the Meeting be chaired by the First Defendant or, if the First Defendant fails to attend the Meeting, that the Meeting be chaired by either:

(a) An elected Member of the Committee; or


(b) A Group Member appointed by the Committee and approved by a majority of the Group Members present.


  1. THAT the Meeting provide for the election of Committee Members for the financial year 2006-2007.
  2. THAT all Group Members including all parents and guardians of disabled children regardless of whether their children currently attend the School or not be afforded the opportunity, in accordance with the Constitution, to attend the Meeting and have their vote counted toward the election of Committee Members.
