vs
TOANI TAKAIO

MEMORANDUM
This trial was listed for Monday 28th February. When the Court sat the Solicitor General apologised to the court: the Republic was not ready to proceed. Mr Tebweao, counsel for the accused, the accused and his witnesses were present. The trial was delayed until the next day, Tuesday 1st March. Before it began the Solicitor General indicated the Republic, if I were to make an order, would pay $80 to Mr Tebweao on account of the expenses of his witnesses because of the day lost. I made the following order:-
Order that the Republic pay to defence counsel the sum of $80.00 on account of the expenses of defence witnesses thrown away when the trial did not begin yesterday.
THE HON ROBIN MILLHOUSE QC
