MINUTES OF ORDER


It is ordered that:


  1. The parties divide the property jointly owned at the date of separation as follows:

  1. The respondent shall within 30 days provide to the applicant written proof from the Development Bank of Kiribati that the mortgage loan on the Kiritimati Motel is no longer secured by either of the properties owned by the applicant on South Tarawa, that she is no longer a guarantor of this loan and that there is no longer any assignment of her salary for this loan. In the event that the mortgage is still secured by any of the applicant's properties or she is still a guarantor of this loan or there is still an assignment of her salary for this loan, the respondent arrange for alternate security, an alternate guarantor and an alternate assignment of salary, all satisfactory to the bank and obtain the release of the applicant's obligations regarding this loan and shall provide her with written proof thereof, within 60 days of this order.
  2. Commencing on Monday March 1st and every second Monday thereafter the respondent will pay to the applicant the sum of sixty ($60) dollars for the support of the child Benji, born July 17th, 1989, until such time as the child turns 21 years of age or until he is able to fully support himself, whichever shall occur first. The payments shall be made by way of direct deposit into the applicant's bank account number 275222-38 at the Bank of Kiribati.
  3. The respondent shall pay to the applicant the sum of five hundred ($500) dollars on account of the joint bank account. The respondent shall pay to the applicant the sum of five hundred ($500) dollars as retroactive child support for Benji since March 2003. The applicant will pay the respondent the sum of two hundred and fifty dollars per year for the support of the child Taawe born March 10, 1984, until the child turn 21 years of age. The respondent shall therefore pay to the applicant the sum of seven hundred and fifty dollars ($750) in total satisfaction of all obligations under this paragraph. This payment shall be made by way of direct deposit into the applicant's bank account number 275222-38 at the Bank of Kiribati, in the amount of one hundred and fifty ($150) dollars per month commencing on April 1st 2004 for five consecutive months ending with August 1, 2004.
  4. Liberty to either party to apply to the court in Tarawa or seven days' notice to the other.
