We gave judgment in favour of the appellant in this appeal on 19 November. Unfortunately in the preceding month there had been a dealing with the land (CN 143/04) which goes against the effect of the appeal.

This is an application to correct the situation. Accordingly we order:

(1) that the case 143/04 be brought to this Court for review

(2) there be in the meantime a stay of proceedings in CN 143/04

Further consideration on 11 February 2005.
