The point of issue is whether an actual boundary determination has ever been made. The Single Magistrate says it has but gives no reference.


Mr Berina is confident that it has but cannot for the moment find the minutes of the case in which it was determined. To test Ms Troup’s argument that no actual determination has ever been made, Mr Berina asks for an adjournment to find the relevant minutes.


Further hearing adjourned to Friday 22 October.
