Barantarawa v Tonganibeia [2003] KIHC 65; Land Appeal 11 of 2000 (16 May 2003)

IN THE HIGH COURT OF KIRIBATI
LAND JURISDICTION
HELD AT BETIO
REPUBLIC OF KIRIBATI

High Court Land Appeal 11 of 2000

Between:

TERETIA BARANTARAWA
Appellant

And:

TAAM TONGANIBEIA
Respondent

For the Appellant: Ms Taoing Taoaba
For the Respondent: Mr Banuera Berina

Date of Hearing: 16 May 2003

JUDGMENT
(Ex Tempore)

The respondent complains about the boundary which the Single Magistrate fixed for a house plot. Having heard Ms Taoaba and Mr Berina and read the Single Magistrate's judgment, it is clear that the magistrate fixed the boundary. None had been fixed before. The Single Magistrate made findings of fact. They are reasonable. We see no reason to disturb them nor the boundary the Single Magistrate fixed.

The appeal is dismissed.

THE HON ROBIN MILLHOUSE QC
Chief Justice

TEKAIE TENANORA
Magistrate

BETERO KAITANGARE
Magistrate
