IN THE HIGH COURT OF KIRIBATI
LAND JURISDICTION
HELD AT BETIO
REPUBLIC OF KIRIBATI

High Court Land Appeal 02 of 2003

Between:

KABOTAU NAKAU
TETABO MARANIA
RARATU IEITA
Appellants

And:

ARAWATAAKE KABWEBWENIBEIA
EMI BOB
Respondents

For the Appellants: Mr Katarake Tebweao
For the Respondents: Mr Aomoro Amten

Date of Hearing: 24 April 2003

JUDGMENT
(Ex Tempore)

The point of this appeal is a complaint about the decision of the Land Commission in CN 77/1947 given on 9/12/47. The appellants have written a long letter setting out their grievances. Mr Tebweao has asked us to read the letter.

The law does not encourage applications for extension of time within which to appeal but does allow extensions sometimes. This appeal is now over 55 years out of time. Far too long. Application to extend time refused.

Appeal dismissed.

THE HON ROBIN MILLHOUSE QC
Chief Justice

TEKAIE TENANORA
Magistrate

BETERO KAITANGARE
Magistrate
