DATE OF HEARING: 1 OCTOBER 2003


It is agreed between the parties that the Defendant is to deliver two two-ton second hand trucks from Japan to the Plaintiff on Tabuaeran Island by 15th January 2004.


If the Defendant fails to deliver the trucks by that date, the Plaintiff is to have judgment against the Defendant for $31,000.


There is to be no order as to costs.


Order accordingly.
