No appearance by respondent (see Sheriff's report of 11 September). The only ground of appeal is that the decision was against the weight of evidence. Having read through the transcript I am not prepared to upset the Magistrate's decision: it was based on seeing and hearing the parties.


Appeal dismissed but with liberty to the appellant to apply within six months of today if the Respondent were to sign a consent duly witnessed.
