Republic v Katioua - sentence [2001] KIHC 64; Criminal Case 45 of 2000 (29 October 2001)

IN THE HIGH COURT OF KIRIBATI
CRIMINAL JURISDICTION
HELD AT BETIO
REPUBLIC OF KIRIBATI

High Court Criminal Case 45 of 2000

THE REPUBLIC

vs

TERARA KATIOUA

For the Republic: Mr Tion Nabau
For the Accused: Ms Taoing Taoaba

Date of Hearing: 15 October 2001

SENTENCE

Terara Katioua you have been found guilty of embezzlement. That is a crime which has a maximum penalty of 14 years' imprisonment.

You were Sales Manager on North Tarawa for the Abamakoro Trading Company. The amount involved is substantial, $9,850.26. The facts are in my judgment convicting you.

You have given no explanation as to what you did with the money. You were in a position of trust and you committed a serious breach of that trust. None of the money has been repaid.

You are married and have eight children, the eldest of whom is 11: your wife and children are dependent on you. Since ceasing to work for the Abamakoro Trading Company you have done some boat building but have not had other work.

I have not been told but I assume this is your first conviction.

You must go to gaol. You will be imprisoned for 2 years from 22 October 2001 when you went into custody.

Dated the 29th day of October 2001

THE HON ROBIN MILLHOUSE QC
CHIEF JUSTICE
