JUDGMENT


Having heard the evidence of Dr Yang I accept that the accused is not fit to plead for the reasons set out in her report of 6 July 2001. I also accept that he needs treatment for mental illness. The doctor said so in her report and has reiterated it in her oral evidence. My only course is to act as set out in S.144(4) of the Criminal Procedure Code. I shall report to the Beretitenti in accordance with that provision. In the meantime the prisoner will remain in custody.
