JUDGMENT
(EX TEMPORE)


This appeal concerns a distribution made in the 1960s. Nearly 30 years later these proceedings were commenced. In 1991 the Magistrates' Court decided against the appellant: this appeal is from that decision. Mr Allen who had his instructions renewed in Court says that the 1960's distribution does seem to have been unfair. That may be so and is unfortunate but nearly 40 years later it was far too late to do anything about it. Others since then quite properly may have acquired rights. The appeal must be dismissed.
