Taunteang v Biira [1999] KIHC 19; HCLA 069.97 (19 March 1999)

IN THE HIGH COURT OF KIRIBATI
(BEFORE THE HON R LUSSICK C.J.)

HCLA 69/97

BETWEEN:

TAANE TAUNTEANG
Appellant

AND:

WILLIAM & MERETIA BIIRA
Respondents

No appearance of Appellant
No appearance of Respondents

Date of Hearing: 19 March 1999

JUDGMENT

Neither party appears. On the last occasion (5 February 1999), both parties were present in court when the appeal was fixed for hearing today. No communication has been received which would explain their non-appearance today. Mr Berina of counsel, who was to represent the appellant, tells us that he has not heard from his client since the matter was last in court, and presumes that his services are no longer required.

In the circumstances, the appeal is dismissed for want of prosecution.
