Tiaterenga v Tabito [1998] KIHC 68; HCLA 049.97 (11 December 1998)

IN THE HIGH COURT OF KIRIBATI
(BEFORE THE HON R LUSSICK C.J.)

HCLA 49/97

BETWEEN:

ATANIMOA TIATERENGA
Appellant

AND:

MARIA TABITO & ORS
Respondents

No appearance of Appellant
Respondent in person

Date of Hearing: 11 December 1998

JUDGMENT

The appellant does not appear today. When the matter last came before the court on 18 September 1998 only the wife of the appellant appeared. We advised her of the importance of having her husband appear on the date set down for hearing which was today. There is no explanation for there being no appearance of the appellant today. The respondent complains that she has wasted her time and money again by having to come to court.

In the circumstances the appeal is dismissed for want of prosecution. The appellant is advised that he has a right to appeal to the Court of Appeal within 6 weeks.
