AND:

PITOI TALIA
1st Respondent

BUREAUA NARUAI

No appearance of Appellant
Mr B Berina for the 1st Respondent
2nd Respondent in person

Date of Hearing: 10 July 1998

JUDGMENT

The appellant makes no appearance. The case was adjourned until today at the appellant's request to enable him to instruct a lawyer. There is no appearance of any lawyer on the appellant's behalf either.

When the case was last before the court on the 19th June 1998 we made it quite clear to the appellant that the hearing of the appeal must proceed today. Mr Berina submits that in the circumstances the appeal should be dismissed and we agree.

The appeal is dismissed for want of prosecution.
