Kamaraia v Temarawa [1997] KIHC 82; Land Appeal 25 of 1990 (23 January 1997)

IN THE HIGH COURT OF KIRIBATI
(BEFORE THE HON R LUSSICK C.J.)

HCLA 25/90

BETWEEN:

RUONAMAKIN KAMARAIA
Appellant

AND:

ATEA TEMARAWA
MAREWENTEATU KAMARAIA
Respondents

JUDGMENT

None of the parties to this appeal appear today.

Numerous attempts have been made, without success, to serve the appellant. Her last known address was Christmas Island. She filed her appeal on 5.2.90 and little, if anything, has been heard from her since.

In any event, her appeal was out of time and she has not applied for leave. Even worse, she was not a party to the proceedings which she seeks to appeal, i.e. BA 131/89, and so has no right to appeal anyway.

In the circumstances, the appeal is dismissed.

THE HON R B LUSSICK
Chief Justice
(23/01/97)

TEKAIE TENANORA
Magistrate
(23/01/97)

BETERO KAITANGARE
Magistrate
(23/01/97)
