The respondent lives in South Tarawa and was not served with a notice of hearing until 25 May 1997, making it impossible to be in Kuria for the hearing on 27 May 1997. By letter he requests an adjournment.


Mr Berina, who appears for the appellant, does not object to an adjournment but applies for the appeal to be transferred to South Tarawa for hearing.


We grant that application. The appeal is transferred to South Tarawa to be listed for hearing as soon as possible.
