JUDGMENT
None of the parties appeared when the matter was called on for hearing today.
We note that the appeal file does not contain a notice of appeal nor any case record.
We think that this appeal (if it is an appeal) is related to HCLA 83/90, which is another matter in the list between the same parties. We cannot say for certain because in the present case there is nothing to indicate what land is involved or what decision is appealed.
In any event, in HCLA 83/90 there is a letter on file from the appellant applying to withdraw that appeal, and she makes specific reference to the sittings in Kuria on the 27th May 1997. The appellant is therefore aware of the sittings and there is no explanation for her non-appearance in the present case.
The appeal is therefore dismissed for want of prosecution.
