JUDGMENT

Both of the named parties to this appeal appear in person. However, the person who filed the appeal and is thus the true appellant - Taoataake Tebanana - died about 2 weeks ago.

Mr Lambourne appears for the true appellant instructed by her son. Mr Lambourne applies to withdraw the appeal.

We note that the appeal has been brought 13 years out of time and that the appellant was not a party to the original proceedings.

On the application of counsel for the appellant the appeal is withdrawn and dismissed accordingly.
