JUDGMENT


The appellant has been served with a notice of hearing but makes no appearance. However, he has sent a telegram to the High Court registry advising that he has appointed a person named Tererei Taeuea to represent him. That person also makes no appearance and no communication has been received from him.


The respondent Titaake is present and ready to proceed. The first-named respondent, Teruatara, is deceased and the other respondent, N. Kaie, is in Tarawa.


In default of appearance by the appellant or his representative, the appeal is dismissed.
