JUDGMENT


The applicant in this application for leave to appeal out of time is now deceased. Her husband appears to represent her.


We note from the record that the applicant was not a party to the original proceedings and so had no right of appeal in any event. If any cause of action exists then it certainly cannot be raised by way of appeal.


The application must fail and is dismissed accordingly.
