Tekiba v Kautunimakin [1996] KIHC 35; HCLA 083.92 (22 July 1996)

IN THE HIGH COURT OF KIRIBATI
HELD AT MARAKEI
(BEFORE THE HON R LUSSICK C.J.)

HCLA 83/92

BETWEEN:

NUARIKI TEKIBA
Appellant

AND:

KAUTUNIMAKIN
TIRAE TAKITI
Respondents

Appellant in person
1st Respondent deceased
Mr D Lambourne for 2nd Respondent

JUDGMENT

Before us is an application for leave to appeal out of time.

There is no explanation as to why the applicant has remained silent for 12 years but in addition to that, and more importantly, he was not a party to the original proceedings and so has no right of appeal in any event.

The application is therefore refused and dismissed.

THE HON R B LUSSICK
Chief Justice
(22/07/96)

TEKAIE TENANORA
Magistrate
(22/07/96)

BETERO KAITANGARE
Magistrate
