Ionatan v Tekabu [1988] KIHC 6; Land Appeal 02 of 1988 (6 June 1988)

IN THE HIGH COURT OF KIRIBATI
NIKUNAU

HCLA 2/88

BETWEEN:

N. TERURUTAAKE IONATAN
Appellant

-v-

NEI RITA TEKABU
NEI NTERE TEKABU
Respondents

6 June 1988

In case NK 212/87 the Magistrate Court (Lands) at Nikunau distributed the estate of N. Tian Deceased.

There were 2 lands only Neineinimatang 18-u and Urintiki 17-ea(i). Only the respondents were present as sisters of the deceased and their common ancestor was their mother Nei Rutan.

Appellant now claims she is entitled to a share as the cousin of the deceased. Her father Ionatan was the brother of N. Rutan. She claims that the Respondents disowned their sister and neglected her, and that she ought to receive something as she cared for the deceased.

We cannot agree that the appellant whose relationship to the deceased is somewhat remote, should have any part in the distribution of this very small estate. Appeal dismissed.
