JUDGEMENT
Timi Atantarawa was convicted by this Court on 26 Mach of offence of false accounting contrary to section 299 of the Penal Code, and Larceny by a Servant contrary to section 266 of the Penal Code.
He now applies for a certificate to enable him to appeal in terms of section 19(b) of the Court of Appeal Act as no matter of law arises which would enable him to appeal against his conviction without leave. He also applies for bail.
In my view his grounds of appeal show little likelihood of an appeal succeeding. The evidence was clear and I refuse a Certificate and bail pending appeal. Timi is entitled to seek leave to appeal from the Court, and to ask for bail from the Kiribati Court of Appeal.
