ORDER OF THE COURT

By consent, the appeal in Civil Appeal 9 of 2009 is allowed. The order of the High Court on damages is set aside and in lieu thereof the appellant is ordered to pay the respondent the sum of $125,000 inclusive of interest and costs. The appeal in Civil Appeal 10 of 2009 is withdrawn and dismissed.
