WORKMEN'S COMPENSATION (AMENDMENT) ACT

AN ACT
TO AMEND THE WORKMEN'S COMPENSATION ACT
ENACTED by the Parliament of the Fiji Islands-
Short title
1. This Act maybe cited as the Workmen's Compensation (Amendment) Act 1999.
Application to workmen employed under the State
2.-(1) Section 4 of the Workmen's Compensation Act (Cap. 94) is amended-
(a) by deleting "This" and substituting-
"(1) Subject to subsection (2), this";
(b) by adding the following new subsections-
"(2) If-
(a) an officer or soldier of the Republic of the Fiji Islands Military Forces suffers injury or death while engaged in, or as a result of being engaged in, military peacekeeping operations overseas; and
(b) external compensation is payable to the officer or soldier, or to his or her estate or dependants, for the injury or death, then-
(i) if the external compensation paid equals or exceed the compensation payable under this Act for this injury or death - no compensation is to be paid under this Act to the officer or soldier, or to his or her estate or dependants, as the case may be;
(ii) if the external compensation paid is less than the compensation payable under this Act for the injury or death - an additional amount is to be paid to the officer or soldier, or to his or her estate or dependants as the case may be, so as to bring the total amount of compensation paid up to the amount payable under this Act;
(iii) if compensation for death or injury has been paid under this Act to an officer or soldier, or to his or her estate or dependants, but the amount of external compensation payable for the death or injury exceeds the amount so paid - the officer or soldier is, or his or her estate or dependants are, entitled to receive the balance of the external compensation so payable.
(3) In subsection (2),"external compensation" means compensation for injury or death payable to an officer or soldier of the Republic of the Fiji Islands Military Forces, or his or her estate or dependants, by the United Nations or other international body which deployed the officer or soldier on peacekeeping duties."
