GOVERNMENT OF FIJI

WATER AUTHORITY OF FIJI (AMENDMENT) DECREE 2013
(DECREE NO. 22 OF 2013)

IN exercise of the powers vested in me as the President of the Republic of Fiji and the Commander in Chief ofthe Republic of Fiji Military Forces by virtue of the Executive Authority of Fiji Decree 2009, I hereby make the following Decree—

A DECREE TO AMEND THE WATER AUTHORITY OF FIJI PROMULGATION 2007

Short title and commencement

1. This Decree may be cited as the Water Authority of Fiji (Amendment) Decree 2013, and shall be deemed to have come into force on 8th August, 2013.

Section 27 amended

2. Section 27 of the Water Authority of Fiji Promulgation 2007 is amended by inserting the following new subsections after subsection (4)—

"(5) In respect of any premises or any part thereof within 30 meters of any sewer maintained by the Authority, the Authority shall, by notice in writing, require the owner of such premises to make a connection of the owner's sewer to the connection point identified by the Authority within 30 days from the date of the notice, after which date, the sewerage rates shall be charged on the premises.

(6) In the event the owner of such premises fails to make a connection within the stipulated time in the notice given by the Authority, the owner shall be liable in addition to the sewerage rate—

(a) for a natural person, a penalty fine of $100 for every six months thereafter until connection is made; and

(b) for a body corporate, a penalty fine of $1000 for every six months thereafter until connection is made."

The Water Authority of Fiji (Amendment) Decree 2013 (Decree No. 22 of 2013), published in the Government of Fiji Gazette No. 76 replaces the Water Authority of Fiji (Amendment) Decree 2013, published in the Government of Fiji Gazette No. 72, which was printed in error.
