Tobacco Control (Amendment) Decree 2014

GOVERNMENT OF FIJI

TOBACCO CONTROL (AMENDMENT) DECREE 2014
(DECREE NO. 25 OF 2014)

IN exercise of the powers vested in me as the President of the Republic of Fiji and the Commander in Chief of the Republic of Fiji Military Forces by virtue of the Executive Authority of Fiji Decree 2009 and section 165(2) of theConstitution of the Republic of Fiji, I hereby make the following Decree—

A DECREE TO AMEND THE TOBACCO CONTROL DECREE 2010

Short title and commencement

1. This Decree may be cited as the Tobacco Control (Amendment) Decree 2014 and shall come into force on a date appointed by the Minister by notice in the Gazette.

(2) The Tobacco Control Decree 2010 shall be referred to as the "Decree".

Section 2 amended

2. Section 2 of the Decree is amended by inserting the following new definition—

""e-cigarette" means any electronic device consisting of a battery-powered heating element cartridgeand atomiser that is shaped like a cigarette, cigar or pipe designed to deliver nicotine or other substances to a user in the form of a vapour;"

Insertion of "e-cigarette"

3. Sections 3, 4, 5, 6, 7, 8, 13, 14, 17, 19, 23, 25, 28, 32 and 33 and Schedules 3, 4, 5 and 7 of the Decreeare amended by inserting "or e-cigarette" after "tobacco product" wherever they appear.
