TRUST ACCOUNTS (AMENDMENT) (NO. 2) DECREE 2009

GOVERNMENT OF FIJI

IN exercise of the powers vested in me as President of the Republic of Fiji and the Commander in Chief of the Republic of Fiji Military Forces by virtue of the Executive Authority Decree 2009, I hereby make the following Decree —

TO AMEND THE TRUST ACCOUNTS ACT 1996

Short title and Commencement

1. This Decree may be cited as the Trust Accounts (Amendment) (No. 2) Decree 2009, and shall come into force on 12th day of November 2009.

Interpretation

2. Section 2 of the Trust Accounts Act 1996 ("the Act") is amended —

(a) by deleting the definition of "Law Society" and substituting the following —

" "Law Society" means the Fiji Law Society, a body whose establishment is continued pursuant to the section 12 of the Legal Practitioners Decree 2009;"

(b) by deleting the definition of "legal practitioner" and substituting the following—

" "practitioner" or "legal practitioner" means a person admitted to practice as a legal practitioner under the provisions of the Legal Practitioners Decree 2009, and includes a person who before the commencement of the Legal Practitioners Decree 2009 was admitted as a legal practitioner in Fiji;"

New section 3A inserted

3. The Act is amended by inserting the following new section after section 5 —

"All law firms to open and maintain trust accounts

3A. Every legal practitioner engaged in the practice of his or her profession or the carrying on of his or her business, either solely on his or her own account or in partnership with any other person or persons, or the firm of which he or she is a partner, must establish and keep a trust account."
