SMALL CLAIMS TRIBUNAL DECREE (AMENDMENT) PROMULGATION 2007
(PROMULGATION No. 35 OF 2007)
IN exercise of the powers conferred upon the Interim Government, and upon the exercise of my own deliberate judgement as President of the Republic of the Fiji Islands as to what is best and good for the people of Fiji, and by the executive authority of the State in accordance with section 85 of the Constitution and such other powers as may appertain, and with the advice of Cabinet, I, Josefa Iloilovatu Uluivuda, make this Promulgation to –
AMEND THE SMALL CLAIMS TRIBUNAL DECREE
Short title
1. This Promulgation may be cited as the Small Claims Tribunal Decree (Amendment) Promulgation 2007.
Sections 8, 11 and 16 amended
2. The Small Claims Tribunal Decree 1991 is amended –
(a) in section 8, by deleting "$2,000" and substituting "$5,000" appearing in subsections (1), (2) and (3);
(b) in section 11, by deleting "$2,000" and substituting "$5,000";
(c) in section 16, by deleting "$2,000" and substituting "$5,000" appearing in paragraphs (a) to (e) of subsection (3) and in subsection (4).
Transitional and saving
3. Any civil case already instituted in the Magistrates' Courts at the commencement of this Promulgation and with respect to which jurisdiction is vested in the Small Claims Tribunal by reason of this Promulgation may, with the consent of the parties, be remitted under an order of a magistrate to the Small Claims Tribunal for hearing and determination.
