DECREE NO. 48
PUBLIC ORDER (AMENDMENT) DECREE 1988
A DECREE TO AMEND THE PUBLIC ORDER ACT
IN exercise of the powers vested in me as President and Commander-in-Chief of the Republic of Fiji, I, acting in accordance with the advice of the Acting Prime Minister and the Cabinet, have made the following Decree-
Short title
1. This Decree may be cited as the Public Order (Amendment) Decree, 1988.
Interpretation
2. In this Decree the "principal Act" means the Public Order Act.
Public Order Act amended-new subsection 10 (3)
3. The principal Act is amended by inserting the following new subsection after subsection (2) of section 10-
“(3) Any member of the Fiji Military Forces may at the request of a police officer, who has ordered the dispersal of a procession, meeting or assembly under the provisions of this section, assist any such police officer in the dispersal of any such procession, meeting or assembly.”.
Public Order Act amended –new subsection 18 (2)
4. Section 18 of the principal Act is amended by-
(a) inserting a dash and then the number "(1)" between the full stop and the word "Any" at the beginning of that section; and
(b) inserting the following new subsection at the end of that section-
“(2) Any member of the Fiji Military Forces may, at the request of any police officer arrest without a warrant any person who, in the opinion of the police officer, is committing, is about to commit, or who, the policeman has reason to suspect, has committed an offence against the provisions of sections 13 or 14.”.
