Prisons and Corrections (Amendment) Decree 2011

PRISONS AND CORRECTIONS (AMENDMENT) DECREE 2011
(DECREE No.11 of 2011)

IN exercise of the powers vested in me as President of the Republic of Fiji and the Commander in Chief of the Republic of Fiji Military Forces by virtue of the Executive Authority of Fiji Decree 2009, I hereby make the following Decree -

A DECREE TO PROVIDE FOR AN AMENDMENT TO THE PRISONS AND CORRECTIONS ACT 2006

Short title and commencement

1.-(1) This Decree maybe cited as the Prisons and Corrections (Amendment) Decree 2011.

(2) This Decree is deemed to have come into effect on the date of commencement of the Prisons and Corrections Act 2006.

(3) The Prisons and Corrections Act 2006 shall be referred to as "the Principal Act".

Section 1 amended

2. Section 1 subsection (1) of the Act is amended by deleting the whole of subsection (1) and substituting -

1.-(1) This Act maybe cited as the Corrections Service Act 2006".

Amendment to all references to "Fiji Prisons and Corrections Services" in the Act

3. The Principal Act and all its subsidiary laws are amended by -

(a) deleting "Fiji Prisons and Corrections Services or Fiji Prisons Service" wherever it appears and substituting "Fiji Corrections Service" and

(b) deleting "Prisons and Corrections" or Prisons Service" wherever it appears and substituting "Corrections Service".

New section 2A inserted

4. The Principal Act is amended by inserting the following new section 2A after section 2 -

2A.-(1) All written laws are amended by -

(a) deleting "Fiji Prisons and Corrections Services or Fiji Prisons Service" wherever it appears and substituting "Fiji Corrections Service" and

(b) deleting "Prisons and Corrections" or "Prisons Service" wherever it appears and substituting "Corrections Service".

(2) All State documents, of any nature whatsoever, are consequentially amended by-

(a) deleting "Fiji Prisons and Corrections Services or Fiji Prisons Service" wherever it appears and substituting "Fiji Corrections Service" and

(b) deleting "Prisons and Corrections" or "Prisons Service" wherever it appears and substituting "Corrections Service".

Section 39 amended

5. Section 39 subsection (1) (a) of the Principal Act is amended by deleting -

(a) "or officers in charge"; and

(b) the comma "," after the word Divisional Supervisors' and substituting with "or".

Section 51 amended

6. Section 51 subsection (1) (e) of the Principal Act is amended by deleting "internationally" and substituting with "intentionally".
